Certainly a matter for concern. Should there be another "legislate from
the bench progressive" appointed to the court, it might be enough to
push Justice Kennedy off the center and to the right. Hard to tell. As
unlikely as it seems, Souter might even come out of his coma and move to
the center. We need to remind ourselves that Stevens, the most
progressive member of the present court, was, after all, appointed by Nixon.
